If you do not agree to the Terms then You are not authorised to use the Site and the Services. Your use of the Site and the Services will be deemed acceptance of the Terms.

Christchurchjobs.co.nz may from time to time revise the terms, therefore advises that You read this page periodically to review the Terms, because any changes will be binding on You.

Your use of this Site and our Service

You are authorised to view and use the Site and the Services, provided it is for lawful purposes relating to seeking employment, information, or advertising solutions.

You may not use the Site for any other purposes to transmit, distribute, store or destroy any material posted on this Site. You ensure that any information that You send to Christchurchjobs.co.nz or any advertiser is accurate and legal. The site, it's employees or associate do not accept any liability from actions of You, the user, advertiser or other party. You agree not to solicite any of our employees or agents for the services or relationships that we have with your business.

You are prohibited from:

1.        posting any material that may infringe any personal right, copyright, moral right, database right, trade mark, patent or any other intellectual right held by any party;

2.        posting any material that contains any viruses, worm or Trojan horse so as to cause any disruption to the Site;

3.        posting any material that contains any data, image or otherwise which is offensive, obscene or indecent or capable of being offensive, obscene or indecent;

4.        posting any incomplete, false or inaccurate information, or information that is not your own;

5.        posting any franchise, pyramid scheme or setting up any other business opportunity.

 Christchurchjobs.co.nz are registered with the Data Protection Commissioner and in accordance with the Data Protection Act  follows security procedures for the storage and disclosure of information, which You 

have given to Christchurchjobs.co.nz. Any personal information that You provide will be treated as confidential information by Christchurchjobs.co.nz. Please note that any information that You provide to a third party will not be covered by Christchurchjobs.co.nz Privacy Statement.

Christchurchjobs.co.nz wants to provide as full a service as possible to recruiters posting job opportunities and services and for candidates posting CVs. Christchurchjobs.co.nz does not make any checks as to the vacancies offered nor is Christchurchjobs.co.nz able to confirm the accuracy of information that any user provides.

Christchurchjobs.co.nz excludes all liability in connection with any information that is provided by both advertisers, recruiters and candidates.

Christchurchjobs.co.nz shall use its reasonable endeavours to ensure that the Site has satisfactory functionality, however Christchurchjobs.co.nz cannot guarantee that the Site will be operational at all times, and as a result will not be liable for any failure or inability to provide a continuous, error free service.

Christchurchjobs.co.nz does not make any representation whatsoever about any job postings or advertisements, which are accessed through the Site or via a link to another website. Christchurchjobs.co.nz shall use its reasonable endeavours to ensure that the material on this website is accurate, but cannot accept any liability for the same as Christchurchjobs.co.nz relies on information provided to it by third parties. Christchurchjobs.co.nz advises that You must satisfy yourself as to the suitability of any candidate, agency, employer or job found through the Site.

Notwithstanding anything else contained in the Terms or on the Site, Christchurchjobs.co.nz shall not have any liability to You in connection with the Agreement howsoever arising in respect of loss of profits or contracts or for special, indirect or consequential loss or damage, or for any increased costs or expenses.

You agree to defend, indemnify and hold harmless Christchurchjobs.co.nz and its affiliates harmless from any and all claims, actions, proceedings, losses, damages, liabilities, costs and expenses, including reasonable legal fees, arising from your use of the Site and / or the Services.

Nothing in these Terms shall seek to limit liability for death or personal injury caused by Christchurchjobs.co.nz  negligence, fraudulent misrepresentation made by Christchurchjobs.co.nz or any other statutory rights, which are not capable of being excluded.

Christchurchjobs.co.nz shall not be liable to You for any direct, indirect, consequential, special or other damage to your computer systems or viruses, scripts, worms, trojan horses or other destructive methods, howsoever caused, resulting from use of the Site.

As a registered and/or logged in Employer/ job seeker /user; information may be disclosed dependent upon  your personal settings selected, or through the application of job searching or, sending applications to vacancies/advertiser or via using contact forms.

Termination

You agree that Christchurchjobs.co.nz has the right at any time to deny or restrict access to the Site or access to third party services. Christchurchjobs.co.nz shall not have responsibility to inform any third party providers of services of restricted or denied access.

Business relationships

Where there is a business relationship; your company using our services or ChristchurchJobs.co.nz is using services from your business; You agree that you will not solicit, or engage any of our employees or agents for any type of employment or service (not candidates). Only with our prior written consent will you engage any employee or agent, failure to notify Job Energy ltd or ChristchurchJobs.co.nz will result in a fee chargable based time used or salary.

We are not a recuritment agency. However due to the nature of our business there is a greater opportunity for businesses and recruitment agencies to target our employees and agents due to the market knowledge and experience they have to benefit from our experience and market knowledge.

A minimum fee of $9,000+GST is invoiced where no permission has been granted. You agree to wiave all rights and will have no rights to offset against any other claim.

General

These Terms may be updated or ammened without notice at any time in the future for the purpose of keeping our terms and conditions compliant to New Zealand law and within our company policies.

The Terms shall constitute the entire agreement and understanding of the parties and supersede any previous agreement between the parties relating to the subject matter of the Terms.

You may not assign any of your rights and obligations under the Terms.

Nothing in the Terms shall oblige Christchurchjobs.co.nz from discontinuing the Site or any other services provided through the Site at some future date.

If any of the provisions are held invalid, illegal or unenforceable for any reason, such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if the Terms had been executed with the invalid provision eliminated. In the event of a holding or invalidity so fundamental as to prevent the accomplishment of the purpose of the Terms the parties shall immediately commence good faith negotiations.

The Terms shall be governed, construed and shall take effect in accordance with the Laws of New Zealand and Common Law; and shall be subject to the exclusive jurisdiction of the New Zealand courts.
